Terms & Conditions - Yoga by the Beach at Southside

1. Definitions

1.1. "Event" means the event named "Yoga by the Beach at Southside”.
1.2. "SDC" means Sentosa Development Corporation.
1.3. "Event Entry Purchase" means the purchase of a Ticket from SDC via the Sentosa Online Store.
1.4. “Event Guest” means an individual who holds a Ticket which has been sold and/or issued in accordance with these Terms and Conditions.
1.5. "Sentosa Online Store" means the online store at www.sentosa.com.sg
1.6. "Ticket" means the confirmation email sent from the Sentosa Online Store confirming the purchase of a ticket, allowing entry to the Event in accordance with these Terms and Conditions.
1.7. "Ticket Purchase" means a purchase of a Ticket via the Sentosa Online Store from SDC.
1.8. “Staff” means a member of the Event’s official staff (for the avoidance of doubt, including without limitation police, auxiliary police and/or security officers providing security arrangements for the Event and SDC’s employees, officers and agents).

2. Tickets

2.1. A Ticket, can be purchased from SDC via the Sentosa Online Store. Ticket prices as reflected on the Sentosa Online Store are in Singapore Dollars (SGD) and include 7% Goods and Services Tax (GST).
2.2. Island admission (if applicable) and transportation charges apply separately.
2.3. Each Ticket includes a Yoga by the Beach at Southside session for 1 hour, and 1 set of Singapore Dollars 15 Southside F&B Voucher, both for 1 person only. Complimentary Yoga by the Beach session only is not available. Ticket with F&B Voucher is required for every participant of Yoga by the Beach at Southside.
2.4. An individual making an Event Entry Purchase is deemed to have accepted and agreed to be bound by these Terms and Conditions and the decisions of SDC. Such individual is responsible for ensuring that he or she has read and understood these Terms and Conditions prior to making an Event Entry Purchase.
2.5. A confirmation email from the Sentosa Online Store will be sent upon successful Ticket Purchase. Upon such confirmation, the Ticket Purchase is deemed to be complete and final.
2.6. Event Entry Purchases shall cease at such date and time as determined by SDC in its sole and absolute discretion. SDC reserves the right to stop or suspend any or all Event Entry Purchases at any time for any reason.
2.7. An Event Guest shall be required to use the Ticket to physically access the Event.
2.8. All Tickets are non-refundable and not exchangeable for cash and shall not be reproduced, duplicated, copied, sold, traded, resold, transferred or exchanged by any individual for any purposes, including but not limited to weather conditions.

3. Southside F&B Voucher Redemption

3.1. All F&B Vouchers issued for Yoga by the Beach at Southside will expire on the 31 December 2021. Strictly no extension of expiry will be allowed. Refunds will not be provided for unredeemed F&B vouchers.
3.2. Event Guests can redeem the Southside F&B Voucher at the Interim Market at Southside before the expiry date. Event Guests will be required to present a valid Ticket for redemption.
3.3. F&B Voucher redemption can be utilised at Food & Beverage outlets in Interim Market at Southside, for dine-in (subject to prevailing Singapore Government SMM regulations) only. Interim Market at Southside operation hours are as follows till further notice:
Mon - Thu: Closed
Friday: 6pm to 1030pm (last order 10pm)
Saturday/Sunday: 1130am to 1030pm (last order 10pm)

3.4. Reservation is required for dining in at the Interim Market at Southside. Please refer to Southside’s website for more information.
3.5. Strictly ONE voucher per transaction, and cannot be used in conjunction with any other promotions or offers.
3.6. Voucher value can be used on all Food and Beverage items and cannot be exchanged for cash. Any unused amount shall be forfeited.
3.7. SDC and Southside will not be responsible for any damaged, lost, stolen or misplaced F&B Vouchers. Southside reserves the right to make changes to the promotion without prior notice.

4. Event

4.1. An Event Guest is deemed to have accepted and agreed to be bound by these Terms and Conditions and the decisions of SDC. Such individual is responsible for ensuring that he or she has read and understood these Terms and Conditions prior to entering the Event.
4.2. Event Guests below 18 years of age are required to seek his or her parent or legal guardian’s permission, and confirm that his or her parent or legal guardian has consented to the terms of this Agreement on his or her behalf.
4.3. The Event is a rain or shine event. In the event that the PSI reaches 301 or above on the day of the Event, the Event shall be suspended or cancelled. SDC reserves the right to delay the commencement or cancel the Event in the event of inclement weather.
4.4. This is not a private one-to-one workshop. The Event instructors will commence the briefing and demonstration on time.
4.5. Only Event Guest with a valid Ticket will be allowed into the Event. SDC will not be responsible for any loss or theft of or damage to a Ticket and shall not under any circumstances be obliged or required to replace a lost, stolen or damaged Ticket.
4.6. All Event Guests are required to bring their own mats. Mats will not be provided due to hygiene reason.
4.7. Food or beverages brought in and/or purchased from outside the Event shall not be allowed into the Event.
4.8. For purposes of ensuring the safety of all individuals at the Event (including but not limited to the prevention of accidents and adhering to necessary Safe Management Measures), an Event Guest shall obey the instruction(s) of any Staff. If an Event Guest fails to obey such instruction(s), he or she shall be removed immediately from the Event in the sole and final discretion of SDC.
4.9. No individual (including without limitation an Event Guest) at the Event shall make or exploit any recording, transmission and/or broadcast, whether audio, visual or audio visual, by any means or media whatsoever of the Event (including any activities or performances of the Event) for commercial or for-profit purposes. If any individual at the Event makes such recording, transmission and/or broadcast, or if SDC has grounds to suspect that such recording, transmission and/or broadcast is being made, SDC may, without compensation or explanation, search, confiscate and/or remove any equipment used or suspected to be used for the making of such recording, transmission and/or broadcast.
4.10. All individuals (including without limitation Event Guests) entering the Event are deemed to consent to being photographed, recorded or videoed by SDC and herewith grant SDC permission to use and/or broadcast such photographs, records and/or videos for SDC’s commercial, publicity and/or promotional purposes (which may include sharing such photographs and/or videos with SDC’s commercial, media, advertising and other partners for such purposes).
4.11. Whilst reasonable precautions will be taken by SDC to ensure the Event Guest’s safety during and at the Event, the Event Guest takes part in the Event at his or her own risk and shall take reasonable care of himself or herself. To the fullest extent permissible by law, none of SDC, its related corporations and associated companies, the employees, officers, third party service provider(s), contractor(s) (and the sub-contractor(s) engaged by such contractor(s)) and agent(s) of SDC and its related corporations and associated companies, and Event sponsors or co-sponsors will be responsible or held liable for any injury or death of an Event Guest howsoever arising from preparation for, attendance at or participation in the Event. The Event Guest is strongly encouraged to consult his or her medical practitioner prior to an Event Entry Purchase and before the Event.
4.12. SDC reserves the right to stop, cancel, vary, amend, change or postpone the Event without any prior notification. For the avoidance of doubt, SDC is not liable to any Event Guest for any changes to any format, line-up, facility or element of the Event.

5. Non-Liability and Indemnity

5.1. In participating in the Event, the Event Guest do so at their own risk, and shall ensure that they are physically and medically able to participate in such activities.
5.2. To the fullest extent permitted by law, none of SDC, its related corporations and associated companies and the employees, officers, third party service providers, contractors and agents shall be responsible or held liable for any loss, damage, injury, cost or expense (including any loss of profit or any special, indirect or consequential loss) however suffered or incurred by or caused to Event Guest arising out of or in connection with Event Guest’s access or use of the booking platform and/or Event Guest’s visit to the Event, whether in an action based on contract, tort or otherwise.
5.3. Event Guest agree to indemnify and hold harmless SDC, its related corporations and associated companies and the employees, officers, third party service providers, contractor and agents (collectively, the “Indemnified Parties”) from and against all actions, proceedings, claims, liabilities (whether criminal or civil), cost, expenses, fees and damages suffered and legal fees and costs incurred by any of the Indemnified Parties arising out of or in connection with Event Guest breach of this Terms and Conditions and/or Event Guest access or use of the booking platform and/or Event Guest participating in the Event.

6. Terms of use and conduct of visitors

6.1. All Event Guests shall be responsible for their personal belongings and/or personal equipment while attending the Event.
6.2. In participating in the Event, all Event Guests are required to take care of the premises and not cause any damage to the premises and/or any of the installations.
6.3. All Event Guests shall leave the venues in a tidy and clean condition.
6.4. No smoking is allowed at the Event.
6.5. All Event Guests shall be mindful of other visitors and members of the public within the Event and in the vicinity of the Event venue and shall cooperate with SDC staff to ensure a safe environment for all such Event Guests and members of the public. All Event Guests shall adhere to all reasonable requests made by SDC staff.
6.6. SDC reserves the right to remove from the venues any Event Guest who are uncooperative, or whose actions and conduct are deemed to be unreasonable and/or detrimental to the enjoyment, well-being and safety of other visitors and members of the public.

7. Miscellaneous

7.1. All Event Guests shall comply with the Sentosa Development Corporation Act and its regulations, and all rules, orders, directives or codes issued by SDC from time to time.
7.2. SDC may, in our sole discretion, update and amend this Terms and Conditions at any time and without liability or prior notice to you. By proceeding with your booking and your visit to the Event following such update shall constitute your agreement to be bound by the updated terms of this Terms and Conditions.
7.3. All Event Guests may not assign or transfer any or part of their rights or obligations under this Terms and Conditions to any party.
7.4. No failure by SDC to enforce any provision in this Terms and Conditions shall constitute a waiver of the right to subsequently enforce that provision or any other provision of this Terms and Conditions. Such failure shall not be deemed to be a waiver of any preceding or subsequent breach and shall not constitute a continuing waiver.
7.5. The Contract (Rights of Third Parties) Act (Cap. 53B) shall not under any circumstances apply to this Terms and Conditions and any person who is not a party to this Terms and Conditions shall have no right whatsoever to enforce this Terms and Conditions or any of its terms.
7.6. If any applicable law or a court of competent jurisdiction holds or declares any provision of this Terms and Conditions to be invalid, illegal or unenforceable (whether in whole or in part), such provision shall be deemed modified to the extent, but only to the extent, of such invalidity, illegality or unenforceability and the remaining provisions of this Terms and Conditions shall not be affected.
7.7. This Terms and Conditions (including all subsequent additions or amendments) shall be governed by and interpreted in accordance with the laws of Singapore. Any matter or dispute arising out of or in connection with this Terms and Conditions shall be submitted to the exclusive jurisdiction of the Courts of Singapore.

Terms & Conditions - Sunset Yoga at FOC Sentosa
• The Yoga Class will start at 18:00, and there is one session on this day only. Each package includes a complimentary Yoga by the Beach session for 1 hour, and a $50 Food & Beverage voucher, both for 1 person only. Complimentary Yoga by the Beach session only is not available.

• The F&B voucher that you are purchasing can only be redeemed on the day of the Yoga Session. It is inclusive of GST and Service Charge and can’t be exchanged for cash or used on any other day. If the value of the voucher is not fully redeemed, no refund in cash or in other means will be given for the balance.

• Just show your email confirmation at the entrance to get access to the Yoga by The Beach. Once you complete the purchase, FOC Sentosa Team will contact you to reserve a table at FOC Sentosa Restaurant for you and your friends after Sunset Yoga by the Beach.

• It is a rain or shine event, and no refunds will be issued. If the PSI reaches 301 or above on the day of the Yoga session, the session shall be suspended or cancelled. Sentosa Development Corporation (SDC) and FOC reserve the right to delay the commencement of the session in the event of inclement weather. Should the inclement weather persist after the delay, the session will be cancelled.

• All guests are required to bring their own mats. Mats will not be provided due to hygiene reasons.

• Please note that there are no showers at FOC Sentosa, but there are public showers 50m from the entrance that you may use at the end of the Sunset Yoga Class.

• For purposes of ensuring the safety of all individuals at the Yoga session (including but not limited to the prevention of accidents and adhering to necessary Safe Management Measures), all guests shall obey the instruction(s) of any staff. If any guest fails to obey such instruction(s), he or she shall be removed immediately from the Yoga session in the sole and final discretion of SDC.

• No individual at the Yoga session shall make or exploit any recording, transmission and/or broadcast, whether audio, visual or audio visual, by any means or media whatsoever of the session (including any activities or performances of the session) for commercial or for-profit purposes. If any individual at the Yoga session makes such recording, transmission and/or broadcast, or if SDC has grounds to suspect that such recording, transmission and/or broadcast is being made, SDC may, without compensation or explanation, search, confiscate and/or remove any equipment used or suspected to be used for the making of such recording, transmission and/or broadcast. 

• All individuals entering the Yoga session are deemed to consent to being photographed, recorded or videoed by SDC and FOC, and herewith grant SDC and FOC permission to use and/or broadcast such photographs, records and/or videos for SDC’s and FOC’s commercial, publicity and/or promotional purposes (which may include sharing such photographs and/or videos with SDC’s and FOC’s commercial, media, advertising and other partners for such purposes). 

• Whilst reasonable precautions will be taken by SDC to ensure the guest’s safety during and at the Yoga session, all guests take part in the Yoga session at his or her own risk and shall take reasonable care of himself or herself. To the fullest extent permissible by law, none of SDC, its related corporations and associated companies, the employees, officers, third party service provider(s), contractor(s) (and the sub-contractor(s) engaged by such contractor(s)) and agent(s) of SDC and its related corporations and associated companies, and sponsors or co-sponsors will be responsible or held liable for any injury or death of a guest howsoever arising from preparation for, attendance at or participation in the Yoga session. The guest is strongly encouraged to consult his or her medical practitioner prior to the Yoga session.

• To the fullest extent permissible by law, SDC shall not be liable for any loss, damage or expense, however caused, suffered or incurred by the guest in connection with the Yoga session, whether in an action based on contract, tort or otherwise. SDC shall not be liable for any indirect or consequential loss, however caused, suffered or incurred by the guest in connection with the Yoga session, whether in an action based on contract, tort or otherwise.
